Biden is Dodging the Court-Packing Question for a Reason

Over this presidential election cycle, there have been many goofs, gaffs, guffaws, and garbles from the Democratic nominee, perhaps none more memorable than the “You ain’t black” moment on The Breakfast Club with Charlamagne Tha God. However, recently, there’s been one critical failure from the Biden campaign that has been, and will be, missed by many.

With the passing of Justice Ruth Bader Ginsberg, The Supreme Court of the United States has been shoved back into the spotlight, especially with the seat opening so close to the election. The President and The Senate Majority Leader are ready and set to confirm Judge Amy Coney Barrett to The Supreme Court while the Democrats strongly oppose this move.

The Democrats have opposed this move and gone so far as to threaten court-packing* if Judge Amy Coney Barrett is confirmed, in an attempt to save The Court from a supposedly solid Conservative majority. Packing The Court, essentially altering the rules, is a move that would fundamentally change the way in which our system of government functions.
*(“Court-packing” refers to increasing the number of seats on The Supreme Court and filling them with Justices selected by The President. This move would require the Presidency and Congress to be in control of the same political party)

The Biden campaign, for its part, managed to steer clear of questions over this court-packing issue for quite some time. That is, until recently, when the question over this decision was put to Biden at a campaign event in Arizona. Biden responded, “They’ll know my opinion on court-packing when the election is over.” Adding that, “[The Republicans are] denying the American people the one shot they have, under constitutional law, to be able to have their input, and that is picking [Ginsburg’s replacement].”

Biden was again asked about this issue, saying, “The moment I answer that question, the headline in every one of your papers will be about that, other than focusing on what’s happening now,” in reference to Judge Amy Coney Barrett’s rushed confirmation process. Biden’s thinking seems to be that giving no answer on this crucial issue is better than giving any answer at all.

Once more, Biden was confronted with this topic at the first presidential debate this past week. Moderator, Chris Wallace, asked Biden, “Are you willing to tell the American people tonight whether or not you will support(…)packing the court-”, cutting off Wallace, Biden stated, “Whatever position I take on that, that’ll become the issue. The issue is the American people should speak! You should go out and vote!” again, opting to avoid the issue entirely instead of taking a side.

This tactic appears to have backfired for Biden though.

After having been asked about this singular issue so often, and refraining from taking a position, the headlines are now about his non-answers.

His most recent comments on this issue are the most baffling so far. In a recent interview from KTNV Las Vegas, Anchor Ross DiMattei asked the Democratic nominee, “…this is the number one thing I’ve been asked about from viewers in the past couple days-”, Biden, interrupting, said, “Well, you’ve been asked by the viewers who are probably Republicans who don’t want me continuing to talk about what they’re doing to The Court right now.” DiMattei chimed back in, asking, “Well sir, don’t the voters deserve to know-”, “No they don’t deserve- I’m not gonna play his game!” Biden retorted.

The Democratic nominee stated, very clearly, that the voters “don’t deserve” to know his position on packing The Court before election day.

This stunning statement on this incredibly important issue is shameful coming from Joe Biden but reveals a key step in the Democrat’s plan to take back power from the hands of the duly elected Republicans and Conservatives within the branches of the American government. By changing the rules, the Democrats are openly telling the American people that if they lose at the ballot box, they will alter the very system itself to remain in power.

Make no mistake about it, Biden is not leaving this issue ambiguous by accident, it’s intentional. If he says no to court-packing now, he and his party will face a backlash next election cycle if they decide to pack The Court. If Biden says yes to court-packing now, Democrats will face the voters at the ballot box this presidential election. Biden and the Democrats are leaving it ambiguous on purpose so that, if Biden wins and the Democrats take back The Senate, they can, free of repercussion, pack The Court with as many Liberal Justices as they see fit to “rebalance the scales of power” within The Supreme Court and solidify an immense Liberal majority for decades to come.

If Biden didn’t plan on packing The Court, he would say so.

He hasn’t.
